How does and doesn't business mediation work?

Mediation means not only an effective out-of-court dispute resolution. It's also about a new culture which drives for responsibility, healthy communication, and the establishment of justice with civilized ways. Mediation works for those who are open to a win-win scheme and cooperation.

In contrast, mediation doesn't work where one party aims to win everything with all legal and illegal ways, or where one party wants to destroy the other. However, as famous American mediator, Kenneth Clock said: "There are situations where mediation doesn't work, but we have no idea how to recognize such cases." Therefore, it makes sense to try mediation in every even "neglected" case. More so, it makes sense to offer mediation to each of your "difficult" partners or counterparties in the event of a dispute or conflict.
