Ukraine to temporarily suspend participation in European Convention on Human Rights
During martial law, Ukraine amended the terms of its declaration of withdrawal from commitments under the European Convention on Human Rights and the Covenant on Civil and Political Rights.
This is stated in a document published on the website of the Council of Europe.
Thus, according to the document, the military leadership of Ukraine is entitled to:
- limit the mobility of civilians,
- search possessions,
- seize property for the state's requirements.
"In accordance with Article 3 of the presidential decree in connection with the introduction of martial law in Ukraine, the constitutional rights and freedoms of a person and a citizen, provided for in Articles 30-34, 38, 39, 41-44, 53 of the Constitution of Ukraine, may be temporarily limited for the period of martial law," the document reads.
In particular, during the period of martial law, the following legal measures may be implemented:
- forcibly expropriate property for the needs of the state,
- introduce a curfew,
- set a special mode of entry and exit,
- introduce a ban on peaceful assemblies and rallies.
In addition, it is allowed to inspect:
- possesions;
- vehicles,
- luggage and cargo,
- service premises,
- housing of citizens.
Ukraine may also prohibit or limit the choice of the place of stay or place of residence of persons in the territory where martial law has been imposed.

For reference:
Ukraine has been in a state of martial law since February 24, 2022. It has been renewed multiple times, with the most recent extension occurring on February 14, 2024. On this date, the Verkhovna Rada [Ukraine's parliament – ed.] voted to prolong martial law for 90 days until May 13, 2024.
Martial law is a special legal regime introduced in a country in the event of an external threat or aggression. Its purpose is to ensure the safety of citizens and the state, protect the sovereignty and territorial integrity of the country, and repel aggression.
It should be noted that on February 5, Ukraine's President, Volodymyr Zelensky, submitted draft laws on the extension of martial law and general mobilization to the Verkhovna Rada.
On February 6, the Verkhovna Rada supported extending martial law and general mobilization for 90 days.
It was reported that if the president signs the document, martial law and mobilization will be extended until May 14, 2024.
On February 12, Volodymyr Zelensky signed laws continuing general mobilization and martial law in Ukraine.
In addition, the Cabinet of Ministers of Ukraine [Ukraine's government – ed.] changed the regulation on territorial recruitment and social support centers and allowed the institutions to work around the clock.
