The European Court of Human Rights obliged russia to ensure the rights of "Azov" prisoners of war

On August 23, the European Court of Human Rights urgently considered Ukraine's petition regarding russia's observance of the rights of captured defenders of Ukraine.
On August 23, 2022, the ECHR urgently considered Ukraine's petition regarding Russia's observance of the rights of captured defenders of Ukraine and extended the application of urgent measures in the interstate case "Ukraine v. Russia (X)" regarding prisoners of war. Having considered Ukraine's petition, the ECHR noted that in the case of 'Oliynychenko v. Russia and Ukraine,' it issued urgent measures to the Russian Federation to immediately ensure the rights enshrined in the Convention, including medical assistance, covering any requests on behalf of Ukrainian prisoners of war, in which sufficient evidence was provided regarding the serious and imminent risk of causing irreparable damage to their physical integrity (Article 3 of the Convention) and/or the right to life (Article 2 of the Convention)," the post noted.
These rights "include any requests on behalf of Ukrainian prisoners of war where sufficient evidence is provided of a serious and imminent risk of irreparable harm to their physical integrity (Article 3 of the Convention) and/or right to life (Article 2 of the Convention)".
The ECHR emphasized that the instructions given to russia regarding Ukrainian prisoners of war continue to apply and noted that they are also applied in the international case "Ukraine v. Russia (X)."
The Strasbourg Court also urgently informed the Committee of Ministers of the Council of Europe about this decision.
"The decision of the ECHR is a confirmation that the court is attentive to all cases related to armed aggression, regardless of whether it is an interstate or an individual case.
Temporary measures in the interstate case of Ukraine against russia now also cover the rights of prisoners of war," Deputy Minister of Justice of Ukraine Iryna Mudra noted.
We will remind that on August 23, Ukraine submitted several new urgent demands to the European Court of Human Rights regarding the Ukrainian military from "Azovstal."
Also, in Mariupol, the occupation authorities plan to hold a lynching of Ukrainian defenders in the philharmonic hall.
The city council emphasizes that the invaders plan to hold a show trial of Ukrainian soldiers in September.
As Rubryka reported, the Ukrainian defenders of "Azovstal" (among them were part of "Azov" fighters) received an order to preserve the lives of personnel.
The soldiers were captured by the russians on the condition that they would be exchanged later.
The first exchange of Mariupol defenders took place in June.
