The Constitutional Court postponed consideration of the law on the land market

The Grand Chamber of the Constitutional Court postponed consideration of the joint petition of 48 and 53 people's deputies on the constitutionality of the law opening the land market in Ukraine.

According to Ukrinform, the judges decided to postpone the hearing because one of the participants in the proceedings didn't arrive. It was the president's representative in the Constitutional Court, Fedir Venislavskyi. He sent a written request to adjourn the court due to his inability to attend. The court granted the request.

The initiators of the constitutional petition claim that land, as an object of Ukrainian people's property rights, is the primary national wealth. It is under the special protection of the state. It primarily refers to agricultural land. According to the deputies, the adoption of the law by the parliament violated the constitutional procedure of consideration and adoption, and its provisions contradict the Constitution.

People's deputies note that only Ukrainian people may decide the legal fate of such an object of property rights as land through an all-Ukrainian referendum.

To recap, the Constitutional Court of Ukraine received the constitutional petition of 53 people's deputies asking to check the law on the land market for compliance with the Constitution in mid-May. It came from the people's deputies of the "Opposition Platform – For Life" party and People's Deputy Oleksandr Dubinskyi.

Also in early May, the court received a petition to repeal the law on the land market from deputies of the "Fatherland" party and members of the "For the Future" parliamentary group.

To recap, on the night of March 31, the Verkhovna Rada passed the law on the market of the agricultural land in the second reading and as a whole. 259 deputies voted. The President signed the law on April 28, 2020. The Rada considered the draft law on the land market from February 6, 2020. Before the second reading, deputies submitted 4,018 amendments.

According to the law, the market for agricultural land in Ukraine is to be launched in stages. First, from July 1, 2021, only to the citizens of Ukraine (individuals) may sell and buy land shares. The total area of land that a person may own will be up to 100 hectares. Companies and legal entities will be able to purchase land from January 1, 2024.
